Agreement To These Terms

These Terms govern your access to Avelluxe. By creating an account, creating an event, joining as a vendor, opening an invitation, RSVP'ing, sending a gift, uploading content, or using Avelluxe, you agree to these Terms.

Avelluxe Services

• Avelluxe provides private event pages, cinematic invitation previews, private invitations, RSVP flows, guest management, messaging, gifts, gallery delivery, Personalized Memories, vendor marketplace tools, check-in tools, and host concierge features.
• Some features may be in preview, limited release, beta, or controlled production use. Avelluxe may improve, change, pause, or remove features as the product evolves.
• Avelluxe is not a venue, caterer, financial institution, tax advisor, legal advisor, payment processor, telecommunications carrier, or emergency service.

Accounts And Roles

• Hosts are responsible for their account, events, guest lists, invitations, content, payment choices, communication settings, and team access.
• Guests may use private invitation links, RSVP, send gifts, upload selfies or media when enabled, view event details, and access galleries they are authorized to view.
• Vendors are responsible for the accuracy of vendor profiles, quotes, availability, services, prices, reviews, communications, and agreements with hosts.
• Admins may access account, event, payment, messaging, security, and operational records only as needed to operate, secure, support, or enforce Avelluxe.

Drafts, Publishing, And Payment

• Hosts may create and preview event drafts before selecting a plan.
• Publishing an event, activating invite links, sending invitations, or using paid capacity may require selecting a plan, completing checkout, or receiving Avelluxe approval.
• Plans may be based on guest capacity, annual seat allocation, communication usage, storage, concierge services, and add-ons.
• No event should be treated as fully published or paid until Avelluxe receives payment confirmation from the payment provider or an approved internal arrangement is recorded.
• Prices, guest limits, credits, annual allocations, add-ons, taxes, and included features may change for future purchases.

Payments, Subscriptions, Taxes, And Refunds

• Platform payments may be processed through Stripe Checkout, Stripe Tax, Stripe billing, or another approved provider.
• Annual subscriptions may renew unless canceled according to the checkout, account, or provider terms presented at purchase.
• Taxes may be calculated and collected through Stripe Tax or another tax provider where enabled.
• Except where required by law or expressly approved by Avelluxe, fees for published events, activated plans, add-ons, concierge services, communication credits, and storage upgrades may be non-refundable.
• Payment status is based on provider confirmations and webhooks, not only on a browser redirect after checkout.

Host Gifts And Connected Payouts

• Guest gifts are separate from Avelluxe platform revenue.
• Direct-to-host gift payouts may require a verified Stripe Connect account or another approved connected payout provider.
• Hosts are responsible for payout eligibility, correct bank details, tax obligations, gift descriptions, refund decisions, and compliance with applicable gift, fundraiser, event, and financial rules.
• Avelluxe may track gift transactions, platform fees, payout status, disputes, refunds, and confirmations for security, accounting, and support.

Invitations, Messaging, And Consent

• Hosts are responsible for having permission to contact guests by email, SMS, WhatsApp, or other channels.
• Hosts must not upload purchased, scraped, or unauthorized contact lists.
• Guests may opt out of eligible messages by using unsubscribe controls or replying STOP where supported.
• Message delivery depends on provider rules, carrier filtering, WhatsApp rules, email deliverability, compliance registration, accurate contact details, and guest device settings.
• Avelluxe may block, rate limit, or refuse messages that appear abusive, unlawful, fraudulent, misleading, excessive, or non-compliant.

Content And Media

• Hosts, guests, vendors, and team members retain ownership of content they submit, subject to the rights granted here.
• You grant Avelluxe a limited license to host, store, process, display, transmit, resize, secure, analyze, and deliver your content as needed to provide the selected event experience.
• You must have rights and permissions for photos, videos, music, voice recordings, documents, names, likenesses, messages, guest lists, vendor information, and event content you upload or submit.
• You may not upload content that is unlawful, harmful, invasive, defamatory, exploitative, infringing, deceptive, malicious, or unsafe.
• Avelluxe may remove or restrict content, events, galleries, accounts, or messages that violate these Terms or create legal, safety, security, or reputational risk.

AI Features

• AI features may help draft event copy, narration scripts, translations, reminders, thank-you messages, timelines, vendor recommendations, background recommendations, and host concierge responses.
• AI output may be incomplete or inaccurate. Hosts must review AI-generated content before publishing, sending, relying on, or using it for an event.
• The host concierge may prepare actions, but risky actions such as sending messages, changing event details, deleting data, publishing, or triggering photo recognition should require host confirmation before execution.
• AI features are subject to the AI Privacy Notice.

Personalized Memories And Biometric Features

• Personalized Memories and photo matching are optional features that require explicit guest consent before biometric processing begins.
• Guests can RSVP and attend without uploading a selfie or participating in face matching.
• Hosts must not pressure guests to provide biometric data and must not upload event photos for unlawful or unauthorized biometric processing.
• Biometric processing is governed by the Biometric Consent Notice.

Marketplace And Vendor Relationships

• Vendor marketplace listings, recommendations, quote requests, bookings, reviews, and messages may be provided as convenience tools.
• Avelluxe does not guarantee vendor availability, performance, licensing, insurance, background checks, pricing, safety, or suitability unless a separate written agreement says otherwise.
• Hosts and vendors are responsible for their own contracts, deposits, cancellations, services, licenses, insurance, taxes, and disputes.

Security And Access

• You must keep account credentials, invite links, guest links, gallery links, QR codes, check-in tools, and admin access secure.
• You may not attempt to access another host's event, guest list, payment record, gift record, gallery, vendor data, or private invitation without authorization.
• You may not bypass rate limits, scan private galleries, scrape invite links, probe APIs, exploit security controls, abuse messaging, or interfere with Avelluxe operations.

Acceptable Use

• Do not use Avelluxe for spam, harassment, fraud, phishing, impersonation, hateful content, illegal activity, unauthorized surveillance, non-consensual biometric processing, malware, or privacy-invasive conduct.
• Do not use Avelluxe to send emergency messages, medical instructions, legal notices, or time-critical safety communications where failure or delay could cause harm.
• Do not resell, reverse engineer, copy, or commercially exploit Avelluxe except as allowed by a written agreement.

Availability And Changes

Avelluxe may experience downtime, provider outages, maintenance, carrier filtering, payment provider delays, cloud provider issues, browser restrictions, or mobile device limitations. We may modify, suspend, or discontinue features when needed.

Disclaimers And Limits

• Avelluxe is provided as available and as permitted by law.
• We do not guarantee uninterrupted service, perfect delivery, error-free AI output, vendor performance, RSVP accuracy, guest attendance, payment approval, tax results, or gallery matching accuracy.
• To the maximum extent permitted by law, Avelluxe and ARMYLIOM ENTERPRISE are not liable for indirect, incidental, special, consequential, punitive, or lost-profit damages arising from use of the service.

Indemnity

You agree to defend and hold harmless Avelluxe and ARMYLIOM ENTERPRISE from claims, losses, liabilities, costs, and expenses arising from your content, guest lists, messages, events, vendor dealings, payment disputes, misuse of the service, or violation of these Terms.

Termination

Avelluxe may suspend or terminate access, restrict features, remove content, cancel invitations, pause payouts, or block messages if we believe there is misuse, legal risk, security risk, nonpayment, fraud, or violation of these Terms.

Changes To These Terms

We may update these Terms as Avelluxe changes. If changes are material, we will update the date above and may provide additional notice through the product, email, or another reasonable method.
